Are roommates protected by the RTA in Ontario?
It depends. If you share a kitchen or bathroom with the owner or their family, RTA doesn't apply. If all roommates are co-tenants on the lease with no owner present, all are protected. Subtenants may have limited RTA protection.
How do I remove a roommate who won't leave?
If you're the head tenant and they're your subtenant, you may need to go to Small Claims Court (not LTB). If they're a co-tenant, you cannot remove them - only the landlord can. If RTA doesn't apply, common law notice requirements apply.
What if my roommate stops paying their share of rent?
If you're all on the lease, you're jointly responsible for full rent regardless of roommate arrangements. You may need to cover their share to avoid eviction and then pursue them in Small Claims Court for their portion.
