Understand legal rent increases in Ontario. Annual guidelines, notice requirements, and when increases are illegal. Information for tenants and landlords.
For rent-controlled units, landlords can only increase rent by the annual guideline (2.1% in 2026, down from 2.5% in 2024 and 2025) once per year with 90 days written notice. Units first occupied after November 15, 2018 are exempt from rent control and have no limit.
A rent increase is illegal if: it exceeds the guideline without AGI approval, occurs less than 12 months after the last increase, proper 90-day notice wasn't given, the notice doesn't use the proper N1 form, or it's applied to a new tenant (rent can't increase between tenancies for controlled units).
If the increase is illegal (above guideline, improper notice, too soon), you can refuse it and continue paying your current rent. If the landlord persists, they may file with the LTB, where you can defend against the improper increase.
