Facing eviction for noise complaints? N5 notice for interference? We can help defend. Tenant representation in London, Ontario.
Yes, if the noise substantially interferes with other tenants' reasonable enjoyment. However, normal living sounds aren't grounds for eviction. The landlord must prove the noise was excessive and unreasonable, not just that someone complained.
An N5 is a notice to end tenancy for causing interference with others' reasonable enjoyment. You have 7 days to stop the behavior. If you do, the notice is void. If you repeat within 6 months, a second N5 cannot be voided and the landlord can proceed to eviction.
Defences include: the noise was reasonable living sounds, the complainant is overly sensitive, poor sound insulation is the real problem, the complaints are retaliatory or discriminatory, or the landlord didn't give proper notice or follow procedures.
Current processing times vary 3-12 months depending on application type and urgency. We work to move your case forward as efficiently as possible.
