Yes. Tenants can challenge N12 evictions by arguing the landlord doesn't genuinely intend to occupy the unit, questioning whether the named person qualifies as family, or showing the landlord has a pattern of N12 evictions suggesting bad faith.
If the landlord doesn't occupy the unit for at least 12 months, the tenant can file a T5 application claiming bad faith. The LTB can order the landlord to pay compensation equal to 12 months rent or the difference between old and new rent.
