How do I evict a problem tenant in Ontario?
The eviction process depends on the reason. For non-payment: serve N4, wait 14 days, file L1. For cause (damage, illegal activity): serve appropriate N-notice, file L2. For personal use: serve N12 with 60 days notice, file L2. We guide you through each step.
Can I evict a tenant for not paying rent?
Yes, non-payment is the most common reason for eviction. After rent is overdue, serve an N4 notice giving 14 days to pay. If unpaid, file an L1 application with the LTB. The hearing typically occurs within 4-8 weeks.
What if my tenant won't leave after eviction order?
If a tenant refuses to leave after an eviction order takes effect, you must file the order with the Court Enforcement Office (Sheriff). The Sheriff will schedule and enforce the eviction. Never attempt self-help eviction - it's illegal.
How long will my LTB case take?
