A bad faith eviction occurs when a landlord uses N12 (personal use) or N13 (renovation) as a pretext to remove a tenant, but never actually occupies the unit or completes the claimed renovations. This is illegal and compensable.
Evidence includes: the unit being re-rented shortly after you left, seeing the unit listed for rent, the landlord or family member never moving in, renovations never happening, or the unit being used commercially instead of residentially.
The LTB can order the landlord to pay: 12 months rent, the difference between your old rent and new rent for up to 12 months, moving expenses, and general damages for distress. Bad faith findings can result in significant awards.
