No. The $50,000 limit is the principal amount only. Pre-judgment interest, post-judgment interest, and costs are on top of that.
Yes. Licensed paralegals have a right of appearance in Small Claims Court under Law Society of Ontario By-Law 4. They can draft your Plaintiff's Claim or Defence, attend the settlement conference, and represent you at trial.
Yes. You can formally waive any amount above $50,000 in your Plaintiff's Claim. Once waived, you cannot recover that excess later — but the savings in time and legal fees often make this worthwhile.
Claims above $50,000 go to the Superior Court of Justice. Claims between $50,000 and $200,000 typically follow the Simplified Procedure under Rule 76 of the Rules of Civil Procedure. Claims over $200,000 follow the standard rules.
